NightStory Terms of Use
Version 1 · Effective November 11, 2026 · The current version is always at https://starrybedtime.com/terms.
These Terms are an agreement between you and NightStory ("we", "us") about your use of the NightStory app. Please read them with our Privacy Policy (https://starrybedtime.com/privacy), which explains what information the app handles and why.
1. Who may set up NightStory
NightStory is for families. It must be set up by a parent or legal guardian who is 18 or older (or of legal age where you live, if that is older). When you continue on the app's sign-in screen, you confirm that you are, and you agree to these Terms for yourself and on behalf of the children you add.
Children may listen to and read stories in the app under your supervision. They do not have their own accounts, and you are responsible for how the app is used on your devices.
2. What NightStory is
NightStory gives you a library of bedtime stories to listen to or read, chosen to suit each child's age. The stories are written, narrated and illustrated in advance with the help of AI tools, and reviewed before they are published. They are the same for every family. The app is free: it has no purchases and no advertising.
We may add, change or remove stories and features, and we may stop offering the app. If we stop offering it, we will tell you in the app where we can, and you can delete your account at any time.
3. Your account
You sign in with Apple, Google or a code we email you; there is no password. One verified email address has one account, and you can be signed in to it on several devices at once. Settings › Sign out signs you out of the device you are holding and removes the account's data from it. You can delete the account, with everything in it, at any time in Settings › Manage account › Delete account (in Settings, tap your name or email at the top, then Delete account). An account nobody has signed in to or used for 12 months is deleted automatically, as the Privacy Policy explains.
Keep your device secure. Anyone who can open the app on it can see and change your children's profiles.
4. Our content, and what you may do with it
The stories, their text, narration and pictures, the app and its design belong to us or to the people who license them to us. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app and its stories for your family's own, non-commercial use, on Apple devices you own or control, as Apple's App Store rules allow.
You may not:
- copy, publish, sell, broadcast or share the stories or recordings outside your family, or use them in any product or service;
- use the stories or any part of the app to train or improve an AI system;
- take apart, reverse-engineer or modify the app, except where the law allows it despite this restriction;
- interfere with our servers, get around their limits, or access the service other than through the app;
- use the app in a way that breaks the law.
5. Stories and their limits
We choose and review stories to be gentle and suitable for young children, and we label each with the ages it suits. Age labels are a guide, not a guarantee: you know your child best, so please listen along or check a story if you are unsure. If a story seems wrong for its age, or contains a mistake, tell us at support@starrybedtime.com and we will look at it.
NightStory is for entertainment and bedtime routines. It is not educational, medical or sleep-therapy advice.
6. Privacy
How we handle information about you and your children is set out in our Privacy Policy. By agreeing to these Terms you confirm that you have read it.
7. Changes to these Terms
When we change these Terms in a way that matters to you, we publish the new version here with a new version number and date, and the app asks you to agree to it before you continue. If you don't agree, you can delete your account from that same screen. Smaller edits that change no meaning (typos, layout) are published without asking again.
8. Ending the agreement
You can stop at any time: delete your account in Settings › Manage account › Delete account and remove the app.
We may suspend or close an account that breaks section 4, or where the law requires us to. If we do, and it is not prohibited, we will not keep the account's information any longer than the Privacy Policy says.
Sections 4 (the restrictions), 9, 10 and 11 continue to apply after the agreement ends.
9. The app is provided "as is"
We work to keep NightStory available, safe and accurate, but we provide it "as is" and "as available". To the extent the law allows, we make no promise that it will always be available, uninterrupted or free of errors, or that every story will suit every child.
If you are a consumer in the EU, the UK or another country with mandatory consumer protections, nothing in these Terms takes away the rights those laws give you. This includes your rights when digital content or a digital service is not as described.
10. Our liability
The app is free. To the extent the law allows, we are not liable for indirect or consequential losses, or for losses you could have avoided by following these Terms.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct where your law says so.
11. The law that applies, and disputes
If you have a question or a complaint, please write to support@starrybedtime.com first: most problems can be solved that way.
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there.
12. Apple and the App Store
You downloaded NightStory from Apple's App Store. Apple's own terms for apps (the Licensed Application End User License Agreement) also apply. In addition:
- These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the app and its content.
- Support: we, not Apple, provide any maintenance and support for the app (support@starrybedtime.com). Apple has no obligation to provide any.
- Warranty: if the app fails to meet any warranty that applies by law, you may tell Apple, and Apple will refund the price you paid for the app, if any (NightStory is free). To the extent the law allows, Apple has no other warranty obligation for the app.
- Claims: we, not Apple, are responsible for any claim relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- Intellectual property: if someone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending and settling that claim.
- Legal compliance: you confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple as a beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce them against you.
13. General
- If a court finds part of these Terms invalid, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- You may not transfer this agreement to someone else. We may transfer it to whoever takes over NightStory, without reducing your rights.
- These Terms, with the Privacy Policy and Apple's terms above, are the whole agreement between you and us about the app.
